Supreme Court Hears First Challenge to Geofence Warrants as Justices Split Over Fourth Amendment Line

The U.S. Supreme Court heard oral arguments on April 27, 2026 in Chatrie v. United States (Docket 25-112), the first constitutional challenge to geofence search warrants to reach the nation’s highest court. Over two hours of argument, the justices appeared deeply divided — some skeptical that smartphone users retain any reasonable expectation of privacy in location data they share with tech companies, others alarmed at the prospect of mass warrantless surveillance of churches, political meetings, and medical appointments.
A ruling is expected by July 2026 and could set nationwide standards for a practice that has grown from a law enforcement novelty into a routine investigative tool, with ABC News reporting that Google alone received 9,000 such warrants in 2019.
What Geofence Warrants Are
A geofence warrant compels a technology company to disclose location data for every device detected within a defined geographic area during a specific time window. In the Chatrie case, investigators drew a radius around a Virginia federal credit union robbed on May 20, 2019, and directed Google to produce records for all users present. As described by the Brennan Center for Justice, the process unfolds in three steps: the company first provides anonymized data on all phones in the specified area; it then provides location data outside the geofence for a subset of requested phones; and finally it discloses account information for a narrowed number of devices.
In Chatrie’s case, Step 1 returned 19 anonymized accounts from a 17.5-acre area that included a church. Step 2 narrowed the pool to 9 accounts. Step 3 identified 3 suspects, among them Okello Chatrie, according to Brookings. A subsequent search of Chatrie’s residences yielded nearly $100,000 in stolen cash, a gun, and demand notes, as SCOTUSblog reported.
Chatrie pleaded guilty while reserving appeal rights. The district court found the warrant lacked required probable cause and specificity but allowed the evidence under the good faith exception. A panel of the Fourth Circuit affirmed, followed by the full Fourth Circuit in what SCOTUSblog described as a “deeply splintered decision” — a 7-7 split on whether a search had occurred at all, according to the Brennan Center. Chatrie was sentenced to nearly 12 years plus 3 years supervised release. The Supreme Court granted certiorari in January 2026.
The Arguments
Defense attorney Adam Unikowsky of Jenner & Block argued that Chatrie “had a reasonable expectation of privacy in his location history, given both its sensitive and revealing nature and the fact that it was stored in his password protected account,” according to IAPP. The warrant, he contended, allowed police to conduct a search of “the virtual private papers of every single person within the geofence” without individualized probable cause — granting officers “unlimited discretion” while effectively deputizing Google as a magistrate, as SCOTUSblog reported.
Deputy Solicitor General Eric Feigin countered that Chatrie was “asking for an unprecedented transformation of the Fourth Amendment.” Location data, Feigin argued, represents “public movements” that Chatrie “affirmatively consented” to allow Google to create by enabling the feature on his device. Restricting geofence warrants would be “debilitating and counterintuitive” and would “impede the investigation of kidnappings, robberies, shootings,” according to SCOTUSblog.
TechCrunch noted that the government’s position framed the warrant as simply directing Google “to locate and turn over the necessary information,” while the defense characterized the practice as “search first and develop suspicions later.”
A Fractured Bench
The justices’ questioning revealed no clear majority. Chief Justice Roberts pressed in both directions: at one point he suggested that users who dislike the arrangement could simply disable location sharing — “If you don’t want the government to have your location history, you just flip that off” — but he also raised the specter of surveillance overreach, asking what would prevent the government from using such warrants “to find out the identities of everybody at a particular church, a particular political organization,” as SCOTUSblog reported.
Justice Sotomayor challenged the government’s consent theory: “If this is consent, that means the government can seek those documents for any reason, not just the commission of a crime, or no reason, correct?” she asked, per ABC News. She also noted that Google’s privacy settings are “opaque to figure out how to turn these things off,” complicating claims of voluntary disclosure. Justice Gorsuch raised the danger that a ruling favoring the government could enable “unfettered access” to cloud-stored email, photos, documents, and calendars “without a warrant,” according to SCOTUSblog.
Justice Kagan questioned why Fourth Amendment protection should hinge only on aggregate patterns of movement rather than “things that you do in one’s life that you particularly don’t want people to know about, such as going to a political event, going to an abortion clinic.” Justice Barrett said she was “struggling” with the question of where privacy expectations begin and end, per ABC News.
Sotomayor and Justice Ketanji Brown Jackson both probed the possibility of a narrow ruling that would require warrants to specify criteria for the narrowing process at Steps 2 and 3, which would impose additional judicial oversight without categorically prohibiting geofence warrants, as Brookings reported. Feigin acknowledged the government “could do” and “has done” more comprehensive court supervision in recent warrants.
A Circuit Split and Rising Stakes
The case arrives against a backdrop of diverging lower-court decisions. A Fifth Circuit panel in 2024 unanimously ruled geofence warrants “inherently overbroad and violate the Fourth Amendment” — a direct conflict with the Fourth Circuit’s position, according to Brookings.
The stakes extend well beyond the Chatrie case itself. Federal agents began using geofence warrants in 2016, and since 2018 departments have filed thousands annually, as TechCrunch reported. The Brennan Center warned in its brief that affirming the practice could pave the way for “reverse search” warrants targeting people based on web searches, video views, or AI prompts — a threat to First Amendment protections alongside the Fourth. Civil liberties advocates have documented cases where the warrants ensnared innocent bystanders and identified individuals attending lawful protests, according to TechCrunch. All warrants remain sealed, limiting public scrutiny of their scope, ABC News noted.
Google has already taken a preemptive step: the company moved its location data storage to user devices rather than servers in 2025 and ceased responding to geofence warrants, according to TechCrunch. Other major companies — including Microsoft, Yahoo, Uber, and Snap — continue storing location data server-side.
What We Don’t Know
The ruling’s scope remains uncertain. Law professor Orin Kerr predicted the court would “likely reject” Chatrie’s arguments and allow geofence warrants with narrower scope restrictions, according to TechCrunch. Attorney Cathy Gellis anticipated “baby steps, not big rules,” suggesting the court “likes geofence warrants but there may be hesitance to fully get rid of them.” Brookings contributor John Villasenor predicted the court is unlikely to either categorically reject or fully endorse such warrants, and will instead focus on procedural safeguards, per Brookings.
Whether the court imposes new warrant particularity requirements, issues a narrow ruling confined to the Chatrie facts, or delivers a broader Fourth Amendment holding, the decision will set the first nationwide standard for a surveillance tool that now reaches across smartphone users, tech platforms, and investigators alike.
