FAA Withdraws Orbital Debris Rule as Startups Race to Build Commercial Cleanup Services

The emerging space debris economy is caught between two opposing forces. On one side, the Federal Aviation Administration formally withdrew its proposed rule requiring commercial launch providers to dispose of rocket upper stages within 25 years, a move made official in a Federal Register notice on January 15, 2026, after SpaceX and other launch companies challenged both its costs and the agency’s legal authority to enforce it. On the other, a wave of commercial startups announced competing debris removal services in March 2026, betting that cleaning up orbit will become a viable business even without regulatory mandates to sustain it. The result is a policy vacuum in which the orbital environment is growing more congested while the market, not the government, decides how to respond.
The Rule That Disappeared
The FAA first proposed the upper stage disposal rule in September 2023, aiming to address a straightforward problem: spent rocket bodies left in orbit after delivering their payloads become long-lived collision hazards. The proposed rule offered launch providers five disposal options, including controlled reentry, relocation to graveyard orbits, and retrieval within five years, according to Gizmodo.
Industry opposition was swift. SpaceX argued that the FAA “grossly underestimates the costs and impacts” of the mandate while overstating its safety benefits. Blue Origin and other rocket companies questioned whether the FAA had the legal authority to regulate orbital debris at all, a jurisdictional argument that resonated with an administration already inclined toward deregulation. President Trump’s August 2025 executive order directing agencies to ease commercial spaceflight regulations provided additional political cover for the withdrawal.
The FAA cited the need to review 40 public comments, six of which raised cost concerns and seven of which challenged the agency’s authority. But the practical effect is clear: U.S. rocket companies abandoned 41 upper stages in orbit over the preceding three years, and 33 of those remain as potential collision hazards. Spent upper stages account for roughly 11 percent of all tracked objects in orbit, according to the European Space Agency.
SpaceX’s own track record on upper stage disposal has improved. In 2024, 13 of 134 Falcon 9 upper stages remained in orbit after successful payload deployments. By 2025, that number fell to three out of 165 launches. But voluntary improvement by the dominant launch provider is not the same as an enforceable standard, and SpaceX’s competitors do not all share its disposal capabilities.
The Debris Problem by the Numbers
The orbital environment that regulators have chosen not to regulate is growing more crowded by the month. Approximately 40,000 objects are now tracked by space surveillance networks, of which roughly 11,000 are active payloads. The European Space Agency estimates an additional 1.2 million debris objects between one and ten centimeters in size and 140 million fragments larger than one millimeter orbit the planet untracked.
SpaceX is lowering approximately 4,400 Starlink satellites from 550 kilometers to 480 kilometers throughout 2026, a reconfiguration prompted in part by a December 2025 satellite anomaly that produced debris fragments. Startups Bet on Debris Removal as a Business
While regulators retreated, the commercial debris removal sector accelerated. Three announcements in March 2026 signaled that the industry is moving from demonstration to operational planning.
Portal Space Systems and Australia-based Paladin Space announced on March 19 a partnership to offer what they call Debris Removal as a Service, a recurring commercial model designed to capture multiple debris objects during a single mission, according to SpaceNews. The service would use Portal’s Starburst spacecraft, an ESPA-class vehicle with one kilometer per second of delta-v capability, combined with Paladin’s Triton payload, which is designed to identify and capture tumbling debris objects up to one meter in size. The companies claim a capacity of 20 to 50 objects per mission. Portal’s Starburst is scheduled for its first flight in late 2026 on a SpaceX rideshare mission, with operational debris removal targeted for 2027. Commercial space station company Starlab Space has signed a letter of intent to integrate the service into future station operations.
Separately, Astroscale selected Isar Aerospace on March 16 to launch its ELSA-M demonstration mission, which would capture and deorbit an end-of-life Eutelsat OneWeb satellite from 1,200 kilometers altitude, a region where natural reentry would take approximately 2,000 years without intervention, according to SpaceNews. The 520-kilogram ELSA-M servicer will fly aboard Isar’s Spectrum rocket from Andoya, Norway. The launch is now scheduled for Astroscale’s fiscal year 2028, beginning May 2027, representing a delay from the original 2026 target. Astroscale’s mission is majority self-funded with support from the UK Space Agency through ESA’s ARTES program.
ESA’s own ClearSpace-1 mission, which would demonstrate debris capture and deorbit of the defunct Proba-1 satellite, has slipped from its planned second-half 2026 launch to 2029 after its original target, a Vespa launch adapter, was struck by debris and rendered unsuitable for the planned capture technique.
The Regulatory Gap
The contrast between commercial ambition and regulatory retreat raises a question the market alone cannot answer: who pays for debris removal when no one is required to prevent debris creation?
The current framework is fragmented. The FCC regulates satellite end-of-life disposal but not launch vehicles. The FAA licenses launches but has now abandoned its attempt to regulate what happens to upper stages afterward. No international body has binding enforcement authority over orbital debris. The result is that debris removal startups must build their business cases on voluntary demand from satellite operators and space agencies rather than on compliance-driven markets.
The Portal-Paladin partnership’s focus on sub-meter debris highlights another challenge. Objects in that size range are too small to be reliably tracked by current surveillance networks but large enough to destroy an active satellite on impact. Cleaning them up requires finding them first, a capability that Paladin’s Triton payload claims but has not yet demonstrated in orbit.
For now, the orbital debris economy exists in an unusual state: growing fast enough to attract venture capital and defense interest, but operating without the regulatory floor that would guarantee sustained demand. Whether the market can solve a commons problem that governments have declined to regulate remains an open question, one that the physics of orbital mechanics will eventually answer regardless of policy choices.
